Returning to Work

I have read in the press and seen on TV the proposed changes to incapacity benefit (ICB) and am worried that I will be affected. I cannot work due to long term illness.

Actually Derbyshire has been part of the Pathways to Work pilot scheme for some time and the government is now proposing to make this a national programme. The idea is to support people trying to work after a lengthy time in benefit.

The government does acknowledge however that some people will not be able to secure employment because of their health. We are assured that such people will not be penalised, in fact there are proposals that benefit will be increased.

If you are called for a work focus interview our advice is that you attend because failure to do so could result in a loss of benefit. The Citizens Advice Bureau will be able to help you with any subsequent appeal you may need to make if benefit is withdraw and you are found fit for work.


What is a work focused interview and what will happen?

You will be allocated a personal adviser and be obliged to attend a series of interviews to discuss your work prospects. You will be helped to draw up an action plan which will form part of a "choices" programme. Help will include access to New Deal and incentives to return to work like job preparation premiums and return to work credit.


I also claim disability living allowance (DLA). Will this stop if I take on some work?

In theory it is perfectly possible to work and retain entitlement to DLA. This benefit concerns itself with your care and/or mobility needs and not whether you are fit for work or not. Obviously if you claimed the mobility component of DLA and your job involved a lot of walking this would be inconsistent. However sedentary jobs would not conflict with the benefit. Similarly your care needs may still have to be fulfilled while you are at work.
